1. Who we are and what these Terms cover
NEXYRA is a software product developed and operated under the Zamora Systems brand in Ecuador.
Zamora Systems is the brand under which the product is developed and operated. It is not, in itself, a company or a legal entity.
NEXYRA IPTV Player ("NEXYRA") is a service operated by Oscar Andrés Zamora Solano, a natural person domiciled in Quito, Pichincha, Ecuador. The controller's full details —registered address, email and phone— are set out in the Privacy Policy.
These Terms govern the use of NEXYRA and, together with the Privacy Policy and the Refund Policy, form the agreement between the user and the service provider. By using NEXYRA the user accepts these Terms.
2. What NEXYRA is and what it is not
NEXYRA is software only: a media player that lets users organise and play sources they provide themselves.
NEXYRA does NOT provide, sell, host, distribute or broker access to:
- Television channels: neither live nor on demand.
- Films, series or events: there is no catalogue of any kind.
- M3U playlists: none are supplied, sold or recommended.
- Xtream credentials: no provider usernames or passwords are given out.
- IPTV servers or subscriptions: no such service is operated or resold.
- Streams or audiovisual content: no content originates from, is stored on, or is relayed through our infrastructure.
3. Sources are provided by the user
All content played in NEXYRA comes from sources the user enters and connects.
- The user provides the sources: playlists, addresses and credentials are theirs and they enter them.
- The user chooses which to connect: the choice is entirely theirs.
- The user is responsible for their origin: where they come from and on what terms they were obtained.
- The user must be authorised: they must hold the rights or authorisation needed to access the content they play.
4. Technical compatibility is not a commercial relationship
That NEXYRA can read a format or connect to a server is a technical feature of the software and nothing more.
In particular, compatibility with a source, provider or format does NOT imply affiliation, endorsement, authorisation, association, sponsorship or approval of that provider or its content, in any sense.
5. Permitted use
The user agrees not to knowingly use NEXYRA to:
- Access unauthorised content: content they have no right to access.
- Unlawfully relay protected content: redistribute without the rights holder's authorisation.
- Circumvent protection measures: bypass DRM or other technical protection mechanisms.
- Infringe third-party rights: copyright, trade marks or other rights of others.
6. Licence
NEXYRA grants the user a personal, limited, non-exclusive, non-transferable and revocable licence to use the software in accordance with these Terms.
The licence is subject to the plan purchased and its device limits. No ownership of the software or any right over it is transferred beyond the use described.
The user may not sublicense, resell, rent or assign their licence to third parties.
7. Intellectual property
The following are owned by Zamora Systems, or used under licence:
- The software: the NEXYRA code, its architecture and its components.
- The brand: the NEXYRA and Zamora Systems names, logos and distinctive signs.
- Our own interfaces: the design, layout and original graphic elements of the app.
- The documentation: manuals, help texts and support materials.
- Original assets: icons, illustrations and other material created for the product.
8. Third-party and user content
NEXYRA acquires NO rights over content belonging to others. In particular, it acquires no rights over:
- The user's playlists: they remain theirs; no ownership over them is claimed.
- Streams and channels: they belong to their respective rights holders.
- Films and series: they belong to their respective rights holders.
- Provider trade marks: they belong to their owners and are mentioned, where applicable, for identification only.
- External content: any material accessed through a user's source.
9. Technical compatibility and content licences
That NEXYRA can play a piece of content grants the user no licence or right over it. Any licence over the content comes from its rights holder, or from whoever is authorised to grant it — never from NEXYRA.
The user declares that they will only use sources for which they hold sufficient authorisation, and is answerable for that authorisation to the relevant rights holders.
10. Devices
Current plans allow use on 1 device at a time.
Linking devices beyond the plan limit, or sharing the licence with third parties, is not permitted.
11. Plans and pricing
The available plans and their prices are:
- Annual: $9.99 USD per year.
- Lifetime: $19.99 USD, one-time payment.
- Free trial: 7 days, once per account, free of charge and with no payment method required.
12. What the Lifetime plan means
The Lifetime plan is a one-time payment: it does not renew and generates no recurring charges.
"Lifetime" does NOT refer to the user's lifetime, nor does it guarantee perpetual availability of the product. It means that, for as long as NEXYRA continues to operate and to technically offer that product, and to the extent permitted by applicable law, the licence purchased requires no further payments.
Should the definitive discontinuation of NEXYRA be foreseen, reasonable advance notice will be sought where technically and reasonably possible, and matters will be handled as applicable law requires.
13. Free trial
The free trial lasts 7 days, is granted once per account and requires no payment method.
The trial is an evaluation period BEFORE purchase. It is not an additional refund window and does not extend any right of withdrawal after payment.
The foregoing is without prejudice to any mandatory right available to the user under Google Play's policies, those of the payment provider used, or applicable law, which shall prevail where applicable.
14. Refunds
Refund conditions are set out in the Refund Policy, which forms part of these Terms. In the event of any inconsistency between the two documents, the Refund Policy prevails.
Nothing in these Terms or in the Refund Policy limits any rights granted to the user on a mandatory basis by applicable law.
In particular, where the purchase is made through Google Play or another payment provider, that provider's refund policies and any mandatory rights under applicable law shall prevail to the extent they apply.
15. Third-party providers and services
How a source behaves depends on the provider operating it, which is unrelated to NEXYRA. Accordingly, no guarantee is given as to:
- Provider availability: it may stop working at any time.
- Stream quality: resolution, stability or continuity of the broadcast.
- Catalogue: what content is offered and for how long.
- Continuity of the third-party service: nor its permanence over time.
- Validity of credentials: they may expire or be revoked by the provider.
- Absence of geographic restrictions: the provider may limit access by region.
16. Recording and catch-up
Where available, recording and catch-up are technical capabilities of the player and depend on the user's source supporting them.
These features grant the user no rights over the content. They should only be used for content the user is authorised to access, and in accordance with applicable law.
17. Account suspension
An account or licence may be suspended on reasonable and justified grounds, in particular:
- Fraud: use of fraudulent payment methods or impersonation.
- Payment manipulation: attempts to alter amounts, references or payment confirmations.
- Licence abuse: sharing credentials or circumventing device limits.
- Serious breach of these Terms: in particular of the permitted use section.
- Security: where necessary to protect the service or other users.
18. Liability
To the extent permitted by applicable law, NEXYRA is not liable for damages arising from the content the user chooses to access, the sources they connect, or the conduct of third-party providers.
To the extent permitted by applicable law, the software is provided as is, without warranty that its operation will be uninterrupted or error-free.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability arising from wilful misconduct or gross negligence and any mandatory consumer rights.
19. Changes to these Terms
These Terms are versioned. When a new version is published, its effective date will be stated.
Material changes require fresh acceptance by the user before further purchase operations. Editorial corrections that do not alter rights or obligations do not require re-acceptance.
20. Governing law
The service is operated from Ecuador and is governed by Ecuadorian law, without prejudice to any mandatory consumer protection rules applicable in the user's country of residence.
